Terms and Conditions of Sale – Luxury Car with Driver

ARTICLE 1

Any reservation made with MARIE VTC constitutes unconditional acceptance of these terms and conditions of sale.

ARTICLE 2 – RESERVATIONS

All services must be reserved and confirmed in writing.

We will then send you an email confirming our availability.

All service reservations must be made no later than 24 hours before the start of the service. The reservation must be made by the customer or by a duly authorized representative.

All reservations must include the following information: the customer’s name and contact information (address, email, phone number), the pickup location and drop-off location for transfers, the desired duration of service, the date and time the service begins, the number of passengers, the ages of any children (for car seats), and the number of pieces of luggage.

A reservation confirmation must be returned to us, by email or mail, marked “Agreed,” and signed by the customer.

ARTICLE 3 – SERVICES

This offer is valid only once.

The service begins at the vehicle’s parking location on the date and at the time specified in the contract previously entered into between the parties.
It ends on the date and at the time the vehicle is returned to its point of departure.

If the customer is late, the driver will wait 20 minutes at the pickup location. After this time, MARIE VTC will consider the service canceled. The customer will be billed for the service, and no refund will be issued.

If the customer is not present at the appointment location, the service will be considered permanently forfeited, the customer will remain liable for payment, and the customer will not be entitled to a refund.

If the customer cannot find the driver, they must call MARIE VTC immediately to avoid being charged the full amount for the service.

Respect for and proper use of the equipment are required. The customer will be held responsible for any damage to the equipment or inside the vehicle and will be billed accordingly.

Smoking is strictly prohibited inside the vehicle.

Wearing a seat belt is required for both front- and rear-seat passengers.

Pets are not allowed in vehicles unless they are in a cage or a bag designed for that purpose.

MARIE VTC is in no way responsible for items left behind in vehicles or elsewhere during the service.

Under no circumstances may the customer require the driver to exceed the speed limit or to commit any traffic violations.

More generally, the driver reserves the right to refuse any instructions and/or requests from the customer that he or she considers likely to compromise the safety of the vehicle’s occupants and other road users.

Our drivers are true professionals; since they are held accountable, they are instructed to comply with and ensure compliance with applicable laws.

MARIE VTC reserves the right to immediately terminate any service if the customer engages in behavior that endangers the safety of the driver, the vehicle, or other road users. The customer will then be billed for the full cost of the service.

Customers who are excessively intoxicated or who are abusive toward the driver will not be permitted to board the vehicles under any circumstances. The customer will then be billed for the full cost of the service.

The volume of luggage carried is proportional to the vehicle's capacity. Passengers remain responsible for their luggage throughout the entire service.

Any change to the route made by the customer or the customer’s principal may result in additional charges, which will be billed to the customer.

The service provided by MARIE VTC, as regulated by Articles L.231-1 through L.231-4 and R.231-1 through R.231-9 of the Tourism Code, consists of providing the customer with a vehicle, which is inseparably linked to the services of a driver.
The service thus includes, in particular:

  • the vehicle provided to the customer;
  • the provision of a driver who speaks at least French;
  • professional liability insurance for passengers transported for a fee, kilometers traveled, vehicle maintenance, fuel, and the duration specified at the time the service was booked
  • transportation of the customer's luggage, to the extent that the vehicle's capacity allows.
  • toll costs

The following are not included in the Service:

  • the cost of parking garages and, more generally, all parking spaces;
  • admission fees for attractions (museums, theaters, castles, stadiums, or other sites);
  • admission fees for public places

ARTICLE 4 – PRICE

Our rates include all taxes and are listed in euros (€).
The applicable VAT rate for transfers is 10%.
The applicable VAT rate for hourly rentals is 20%.

The transfer rate applies to direct travel, without stops or layovers, from the pickup location to the destination specified in the contract.

Prices are per vehicle, regardless of the number of passengers (up to 7 for minivans).

For vehicle rental, any hour that has begun is charged.
Any kilometers in excess of the flat rate specified in the contract will be billed at €1.50 (including tax) per kilometer.
Any hours in excess of the flat rate specified in the contract will be billed at €45 per hour.

For trips scheduled to last several days, the following flat rates will be charged to the customer:

  • meal = 25€ (including tax)
  • One night at a hotel + breakfast = 120€ (including tax)

Our rates include:

  • VAT
  • the vehicle provided to the customer;
  • the provision of a driver who speaks at least French;
  • professional liability insurance for passengers transported for a fee, kilometers traveled, vehicle maintenance, fuel, and the duration specified at the time the service was booked
  • transportation of the customer's luggage, to the extent that the vehicle's capacity allows.
  • amenities provided on board service vehicles (Wi-Fi, cold drinks, refreshing wipes, daily newspapers, phone chargers)
  • the cost of tolls.

Our rates do not include:

  • the cost of parking garages and, more generally, all parking spaces;
  • admission fees for attractions (museums, theaters, castles, stadiums, or other sites);
  • admission fees for public places;
  • the driver's meal and lodging expenses for a trip lasting several days.

ARTICLE 5 – RULES

Our services are payable in cash, in euros, on board the vehicle, upon picking up the customer, except for our “Key Account” customers and Partners, for whom periodic invoices are issued.

We accept payments by bank transfer, cash, and credit card (Visa, Mastercard, American Express, etc.).

For our “Key Account” clients and partners, payments are due in full upon receipt of the invoice, unless otherwise specified in a specific contract.

No discount is offered for payment made prior to the date of service.

In any case, the customer who signed the reservation is solely responsible for paying for the service in the event that the user fails to pay.

Any additional services, or any excess kilometers or time, will be billed in accordance with the prices listed on the order form.

Any hour that has begun is charged in full.

For wedding or excursion packages, the reservation is not considered final until a non-refundable deposit equal to 30% of the total cost of the service has been paid.

ARTICLE 6 – CANCELLATION

Any cancellation of a reservation made less than 24 hours before the start of the service will be considered a no-show and billed to the customer.

If the customer is kept waiting for more than 20 minutes at the pickup location, the service will be considered rendered and billed to the customer.

If the customer is absent, the service will be considered due and will be billed.

ARTICLE 7 – LIMITATIONS OF LIABILITY

MARIE VTC cannot under any circumstances be held liable for delays in rail or air travel.

MARIE VTC cannot under any circumstances be held liable for delays caused by traffic conditions beyond its control: road closures, bridges closed to traffic, traffic jams, flooded roads, demonstrations, weather conditions, police, fire department, or customs interventions, etc. (non-exhaustive list).

MARIE VTC cannot under any circumstances be held liable for delays directly resulting from an initial delay on the part of the customer, or from the need to complete a trip, at the customer’s request, within a timeframe that is clearly too short.

In the event that the vehicle is rendered inoperable due to a mechanical failure, an accident, or damage (theft, vandalism), MARIE VTC will make every effort to ensure the continuity of the trip by arranging for a vehicle from another company and undertakes to notify the client.

ARTICLE 8 – INSURANCE

MARIE VTC's liability is limited to the terms of our insurance policy.

Our vehicles are insured for the transportation of passengers, and our passengers are covered by our insurer for all bodily injury. This insurance also covers professional liability, in accordance with current French regulations, pursuant to Article L. 3120-4 of the French Transport Code.

The client shall have the full right to purchase, at their own expense, supplemental insurance covering cancellation fees, repatriation costs, or transported luggage.

ARTICLE 9 – PERSONAL DATA

MARIE VTC is committed to respecting the privacy of its customers.

MARIE VTC is committed to protecting the confidentiality of personal data collected on its website in accordance with the French Data Protection Act No. 78-17 of January 6, 1978. As such, MARIE VTC undertakes not to disclose to third parties any information provided by the customer on its website and to use such information solely for the purpose of processing the customer’s reservation.
The customer may exercise the right to access their personal data file and the right to correct or delete information concerning them by submitting a request to MARIE VTC’s Customer Service department.

ARTICLE 10 – DISPUTES

All claims must be submitted in writing by certified mail to the attention of Customer Service within a maximum of 8 days. After this period, no claims will be accepted.

Subject to applicable legal provisions, any dispute shall, by express agreement, fall under the exclusive jurisdiction of the Commercial Court of Tarascon (Bouches-du-Rhône).
